Special Counsel Robert Mueller referred an investigation of Michael Cohen to the U.S. Attorneys Office in the Southern District of NY.
Avenatti had tweeted on Friday about Cohen's ordered appearance with a comment that the "weather forecast for Monday looks very Stormy". However, Judge Kimba Wood ordered prosecutors to catalogue the seized material and load it into a searchable database and then share it with defense attorneys. But the connection between the two men inserted another high-profile, polarizing Trump ally into the drama surrounding the criminal investigation of the president's longtime lawyer.
The president had backed an attempt to obtain a restraining order that would have stopped justice department prosecutors sifting through documents, tapes and electronic devices seized from Michael Cohen. He is one of three clients of Cohen's in the past year. If you go back and watch Hannity's coverage of the Cohen raid, knowing that he has skin in the game, "we can see that Hannity wasn't just mad, he was scared", Noah said, playing some clips.
"Fairness and justice - as well as the appearance of fairness and justice - require that, before they are turned over to the Investigative Team, the seized materials relating to the President must be reviewed by the only person who is truly motivated to ensure that the privilege is properly invoked and applied: the privilege-holder himself, the President", Hendon wrote.
On Friday, the Justice Department revealed that Michael Cohen, President Donald Trump's personal lawyer, is under criminal investigation. I never retained him, received an invoice, or paid legal fees.
When Wood questioned Cohen's attorneys as to the legal ground for withholding the individual's name, they said he had asked Cohen to do so over the weekend, and that Cohen had a responsibility toward his client.
Prosecutors argued in their own filing Friday that the investigation of Cohen focuses on his private business dealings and that evidence uncovered so far indicates Cohen has done "little to no legal work".
The documents could shed light on the president's relationship with a lawyer who has helped navigate some of Mr. Trump's thorniest personal and business problems. Meanwhile, prosecutors suggest that a separate group of government lawyers should "review the material first and determine what's covered by the attorney-client privilege", reports Bloomberg.
Wood, the judge in the case, was famously nominated for USA attorney general by President Bill Clinton in 1993, only to have her nomination withdrawn over revelations that she had employed an undocumented worker. "The president trusted Mr. Cohen as his fixer for years". Trump himself has denied knowing anything about Cohen's efforts to pay off his accusers, and has also denied the affairs. Trump has said he did not know about the payment, and has denied the underlying claims about the affair with Daniels, calling it "fake news".
