In papers filed in Nantucket District Court after Spacey was arraigned on a single felony count of indecent assault and battery, the 59-year-old actor's lawyers targeted the integrity of the alleged victim who was 18 years old during the encounter that has led to the criminal charge.
The felony charge comes from a 2016 incident in which the House of Cards actor is alleged to have stuck his hands down an 18-year-old's trousers and grabbed his genitals after buying him drinks at a Nantucket restaurant.
The two-time Oscar victor - for his supporting role in Usual Suspects in 1996 and his lead role in American Beauty in 2000 - told the judge in a letter that he intends to plead not guilty.
His lawyer had earlier asked the judge to allow the hearing to happen without Spacey present, but that request was refused. His lawyer is claiming these records are proof that Spacey did not assault the victim in a Nantucket bar. The court agreed to waive Spacey's appearance; however, he must be available by phone.
In a statement to PEOPLE, Mitchell Garabedian, the civil attorney for the alleged victim, wrote, "By reporting the sexual assault, my client is a determined and encouraging voice for those victims not yet ready to report being sexually assaulted".
He said that after three minutes of this, Spacey went to the bathroom. He told police that Spacey bought him a bunch of drinks, and tried to convince him to go back to his house.
Spacey could face up to five years in prison if convicted. The teen told police that he sent his girlfriend a video of the incident, which she confirmed.
Prosecutors requested Spacey have no contact, direct or indirect, with his accuser, which the judge granted.
Spacey had been silent since his apology until late December, when he posted a video to his Twitter account speaking directly to the camera in the persona of his "House of Cards" character Frank Underwood.
Spacey is one of dozens of men in the entertainment industry and politics who have been accused of sexual misconduct in the past 10 months, partly as a result of the #MeToo social media movement. It was unclear whether he was referring to the charge.
Spacey said he did not remember such an encounter but apologized if the allegations were true.
His career offers dried up after he was accused by actor Anthony Rapp in 2017 of making a sexual advance on him in 1986 when Mr Rapp was 14 years old.
