NY is the first USA state to ban vape products by executive emergency order.
Multiple lawsuits have been filed, and House Democrats have launched an investigation into the e-cigarette epidemic as the Centers for Disease Control is analyzing 380 vaping-related cases of lung disease, including six deaths.
MI was the first state to ban the sale of flavored e-cigarettes last week.
Juul Labs, Inc., the company with the biggest footprint in the industry, has said it agrees with the need for action in the flavored e-cigarette sector and will comply with any final state and federal regulations.
The move could later be extended to an outright prohibition of vaping if adolescents migrate to tobacco flavors, seen as more legitimate products that help smokers quit their habit, said the Food and Drug Administration (FDA), which regulates e-cigarettes. They could be in effect as soon as two weeks with a limited grace period given to retailers.
The New York State Department of Health has recently released data indicating that nearly 40% of 12th grade high school seniors and 27% of high school students overall "are not using e-cigarettes". The ban, it added, would force the closure of every Main Street America "mom and pop" vape shop in NY.

Howard Zucker said in the emergency meeting that officials would take a closer look at menthol to decide whether it should be banned as well. The ban does not prohibit menthol or tobacco-flavored e-cigarettes.
Last week, the Trump administration announced plans to remove all flavored e-cigarettes from store shelves. "And I think they have been opportunistic on seizing on [VAPI] to ban all of these products without giving thought to the broader implications".
Although New York is targeting the kinds of flavored e-cigarettes most likely to appeal to young users, it's allowing some concessions. Some members of the panel and groups like the American Heart Association felt the executive order should have been amended to include menthol.
"Today's filing is necessary to protect the public health", Khaldun said. MI approved a ban that includes menthol, but not tobacco flavor, but rules for enactment have not yet been put into place.
